Ans. No. It is granted on facts and circumstances of each case. If urgency is proved and bank has violated provisions/ procedure then DRT would entertain such application. Generally DRT looks into two things: (i) Whether you have prima facie case? and (ii) Whether you will suffer irreparable loss if bank is allowed to proceed with auction.
Can auction be cancelled after its been sold?
Ans. Once auction is done and ownership is transferred to third party through sale certificate, it would become extremely difficult to cancel the same. Legal proceedings for recovery would still remain but getting your property back would be challenging task.
What happens if I miss deadline under SARFAESI?
Ans. Legal options aren’t over even if you missed deadlines under SARFAESI. But your options get limited considerably once time is over. For e.g. : You can still file suit under DRT but court might not be inclined to grant you immediate relief.
